This programme is an advancement from the Postgraduate Certificate in Law, developed for practitioners, by practitioners. It focuses on developing technical and practical proficiency through innovative learning methods.

The learning objectives and assessment criteria are directed to professional, effective and practical presentation of work, oral and written communication skills, demonstration of relevant content and practical knowledge, and higher-order thinking with advanced and integrated application of professional knowledge and skills.

The student is required to complete eight (8) subjects. Students who have already completed the Postgraduate Certificate in Law are required to complete a further four (4) subjects only, and may not repeat modules already taken at Certificate level. Students who successfully complete the Postgraduate Diploma in Law will be able to apply for the Master of Laws with the University of Hertfordshire for a one-year top-up to graduate with the LLM.

  • Explore the key factors involved in determining the applicable law for arbitration proceedings, covering methods for identifying the governing law, the role of mandatory rules and relevant substantive laws, the relevance of lex mercatoria, and arbitration procedure from initiation through to the taking of evidence.

International Commercial Arbitration: Jurisdiction & Enforcement

  • Examine the scope and limitations of the arbitration tribunal's power over the dispute and the parties, including arbitrability, the principle of Kompetenz-Kompetenz, protective and provisional measures, the form and content of arbitration awards, grounds for challenge and enforcement, and multiparty and multicontract disputes.

International Commercial Arbitration: The Infrastructure

  • A recognised Bachelor of Laws qualification (private or foreign qualifications assessed on a case-by-case basis); and
  • The BAC Postgraduate Certificate in Law, or another recognised postgraduate qualification of equivalent level
